SwiftKick is operated by Gallantree Pty Ltd and its related bodies corporate. We are committed to operating the service in line with Australian law and good industry practice. This page summarises the key compliance frameworks we maintain.

Regulatory framework

SwiftKick’s operations are governed by, among others:

• the Privacy Act 1988 (Cth) and the Australian Privacy Principles;
• the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth) in respect of electronic communications;
• the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth);
• the Copyright Act 1968 (Cth) and the Trade Marks Act 1995 (Cth) in respect of intellectual property; and
• applicable State and Territory laws regulating trade promotions and competitions where relevant.

Not a gambling service

SwiftKick is a free social tipping platform. We are not a bookmaker, betting exchange or gambling service licensed under the Interactive Gambling Act 2001 (Cth) or any State or Territory wagering legislation, and we do not require such a licence: no consideration is paid to SwiftKick to enter a tipping comp, and no cash prizes or other gambling-related benefits are awarded by SwiftKick. Comps are for entertainment and group competition only.

Privacy and data protection

We comply with the Australian Privacy Principles in our handling of personal information, including collection, use, disclosure, storage, access and correction. Our Privacy Policy describes how this works in practice. Personal information is held using appropriate physical, technical and administrative safeguards, including encryption in transit, access controls and regular review of our systems.

Responsible use

SwiftKick is intended for adults aged 18 or over. We do not promote, link to or share revenue with online wagering operators in our editorial content, and we do not place gambling advertisements in the product. Content integrity and moderation

We monitor user-generated content (such as comp names, team names and comments) for material that is unlawful, harassing, defamatory or otherwise inconsistent with our Terms of Use. We may edit or remove content, suspend accounts and remove comps where required to maintain the integrity of the service.

Workplace integrations

Our Slack and Microsoft Teams integrations are built against each vendor’s developer policies and use only the minimum scopes required to deliver reminders, post results and resolve user identities. Workplace administrators control whether the SwiftKick app is installed in their environment.

Security incident handling

We maintain procedures for identifying, containing, investigating and responding to security incidents, including notifiable data breaches under Part IIIC of the Privacy Act. Where a notifiable data breach occurs, we will notify affected individuals and the Office of the Australian Information Commissioner in accordance with the law.

Whistleblower protections

As part of the Gallantree group, SwiftKick is covered by Gallantree’s Whistleblower Policy, which is consistent with Part 9.4AAA of the Corporations Act 2001 (Cth). Eligible whistleblowers can make protected disclosures about misconduct or an improper state of affairs and are afforded the protections provided by law, including confidentiality of identity and protection from victimisation.

Modern slavery

We are committed to identifying and mitigating the risk of modern slavery in our operations and supply chain, consistent with the principles of the Modern Slavery Act 2018 (Cth).
