Terms of Use

These Terms of Use govern your access to and use of the SwiftKick website at swiftkick.com.au and any related apps, integrations and services (the “Site”), operated by Gallantree Pty Ltd and its related bodies corporate (together, “SwiftKick”, “we”, “us” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site.

Eligibility and accounts

You must be at least 18 years old to create a SwiftKick account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.

Use of the Site

You may use the Site for lawful, personal and group-competition purposes only. You must not use the Site to place, accept or facilitate any bet, wager or gambling transaction; breach any applicable law; attempt unauthorised access to the Site or our systems; introduce malicious code; use automated scraping tools or scripted access without our prior written consent; reverse engineer the Site or any part of it; or transmit unsolicited commercial communications or content that is unlawful, harassing, defamatory, obscene or otherwise objectionable.

Tipping comps

Tipping comps run on the Site are social competitions for entertainment and group bragging rights. SwiftKick does not accept wagers, hold stakes, or guarantee or pay any prize. Any prize a comp organiser awards within their own group is the sole responsibility of that organiser. Decisions on ladder positions, tie-breakers, scoring rules and late tips are governed by the published rules of each comp; SwiftKick’s decision on system-level scoring is final.

Intellectual property

All content on the Site, including text, graphics, logos, images, audio, video and software, is the property of SwiftKick, Gallantree or our licensors and is protected by copyright, trade mark and other intellectual property laws. You may view and download content for personal, non-commercial use, provided you retain all copyright and other proprietary notices.

Names, logos and fixtures of the NRL, AFL, NBA, Premier League, MLB, NHL and their respective clubs remain the property of their respective owners and are used for identification only.

Your content

You retain ownership of any tips, comments, comp configurations, team names and other content you submit. You grant SwiftKick a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and distribute that content for the purpose of operating the Site, generating ladders and statistics, and providing the service to you and the other members of your comp.

Information disclaimer

Information on the Site — including fixtures, results, ladders, tipping statistics and editorial commentary — is provided for general information and entertainment purposes only and does not constitute financial product advice, investment advice, legal advice, tax advice or a recommendation to place any bet or wager. Linked websites

The Site may contain links to third-party websites and services. We do not control, endorse or assume any responsibility for the content, products, practices or policies of those websites or services.

No warranty

The Site is provided on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components, or that information on the Site is accurate, complete or current.

Limitation of liability and indemnity

To the maximum extent permitted by law, SwiftKick excludes all liability for any loss, damage, cost or expense (including indirect, consequential or economic loss) arising from your use of, or reliance on, the Site. You agree to indemnify SwiftKick against any loss, damage, cost or expense we suffer or incur as a result of your breach of these Terms or your unlawful use of the Site.

Changes and termination

We may update these Terms from time to time. Material changes will be notified through the Site or by email. We may suspend or terminate your access to the Site if you breach these Terms or use the Site in a way that risks harm to other users or to us.

Governing law

These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
